AN ACT
  relating to the confidentiality and disclosure of certain financial
  information of perpetual care cemeteries and perpetual care trust
  funds.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 712, Health and Safety
  Code, is amended by adding Section 712.010 to read as follows:
         Sec. 712.010.  CONFIDENTIALITY AND  DISCLOSURE OF CERTAIN
  INFORMATION.  (a)  Information relating to the financial condition
  of a perpetual care cemetery or fund the department obtains
  directly or indirectly, through examination or otherwise, other
  than a published statement, is confidential.
         (b)  A department file or record relating to the financial
  condition of a perpetual care cemetery or fund is confidential.
         (c)  The commissioner may disclose information described by
  Subsection (a) or (b) to an agency, department, or instrumentality
  of this or another state or the United States if the commissioner
  determines disclosure is in the best interest of the public and
  necessary or proper to enforce the laws of this or another state or
  the United States.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2025.
