A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the confidentiality of certain financial information |
|
|
related to perpetual care cemeteries. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 712, Health and Safety |
|
|
Code, is amended by adding Section 712.010 to read as follows: |
|
|
Sec. 712.010. CONFIDENTIALITY AND DISCLOSURE OF CERTAIN |
|
|
FINANCIAL INFORMATION. (a) Except as provided by Subsection (b), |
|
|
records or other information retained by the department that relate |
|
|
to the financial condition of a perpetual care cemetery or |
|
|
perpetual care trust fund are confidential and not subject to |
|
|
disclosure under Chapter 552, Government Code. |
|
|
(b) The department may disclose records or other |
|
|
information described by Subsection (a) to this state, a political |
|
|
subdivision of this state, or an agency of this state if the |
|
|
department considers disclosure to be in the best interest of the |
|
|
public or necessary or proper to aid in the enforcement of a law or |
|
|
rule. |

|
SECTION 2. This Act takes effect September 1, 2025. |
