A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the confidentiality and disclosure of certain financial |
|
information of perpetual care cemeteries and perpetual care trust |
|
funds. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 712, Health and Safety |
|
Code, is amended by adding Section 712.010 to read as follows: |
|
Sec. 712.010. CONFIDENTIALITY AND DISCLOSURE OF CERTAIN |
|
INFORMATION. (a) Information relating to the financial condition |
|
of a perpetual care cemetery or fund the department obtains |
|
directly or indirectly, through examination or otherwise, other |
|
than a published statement, is confidential. |
|
(b) A department file or record relating to the financial |
|
condition of a perpetual care cemetery or fund is confidential. |
|
(c) The commissioner may disclose information described by |
|
Subsection (a) or (b) to an agency, department, or instrumentality |
|
of this or another state or the United States if the commissioner |
|
determines disclosure is in the best interest of the public and |
|
necessary or proper to enforce the laws of this or another state or |
|
the United States. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2025. |
