A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the fee for public inspection of election records. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1.012(e), Election Code, is amended to |
|
|
read as follows: |
|
|
(e) Except as provided by Subsections (f) and (g), an |
|
|
election record shall be available not later than the 15th day after |
|
|
election day in an electronic format for a fee to be paid by the |
|
|
requestor, not to exceed the lesser of: |
|
|
(1) the cost of the materials, excluding labor, |
|
|
necessary to respond to the request; or |
|
|
(2) $300 [of not more than $50]. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
