A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the election dates for certain special and runoff |
|
|
elections. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2.025(d), Election Code, is amended to |
|
|
read as follows: |
|
|
(d) A runoff election for a special election [to fill a |
|
|
vacancy in Congress or a special election to fill a vacancy in the |
|
|
legislature], except an election ordered as an emergency election |
|
|
under Section 41.0011 or an election held as an expedited election |
|
|
under Section 203.013, shall be held not [earlier than the 70th day |
|
|
or] later than the 30th [77th] day after the date the final canvass |
|
|
of the main election is completed. |
|
|
SECTION 2. Section 41.007(b), Election Code, is amended to |
|
|
read as follows: |
|
|
(b) The runoff primary election date is the fourth Tuesday |
|
|
[in May] following the general primary election. |
|
|
SECTION 3. Section 203.004(a), Election Code, is amended to |
|
|
read as follows: |
|
|
(a) Except as provided by Subsection (b), a special election |
|
|
shall be held not later than the 90th day after the date the vacancy |
|
|
occurs, unless the vacancy occurs on or after the 120th day before |
|
|
and not later than the 36th day before the date of the next uniform |
|
|
election date, in which case the special election shall be held on |
|
|
the first uniform election date occurring on or after the 36th day |
|
|
after the date the election is ordered. |
|
|
SECTION 4. This Act applies only to an election ordered on |
|
|
or after the effective date of this Act. |
|
|
SECTION 5. This Act takes effect September 1, 2025. |
