A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to interagency sharing of certain information related to |
|
|
individuals disenrolled from Medicaid. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 532, Government Code, as |
|
|
effective April 1, 2025, is amended by adding Section 532.0207 to |
|
|
read as follows: |
|
|
Sec. 532.0207. MEMORANDUM OF UNDERSTANDING WITH TEXAS |
|
|
DEPARTMENT OF INSURANCE FOR PROVISION OF CERTAIN INFORMATION. (a) |
|
|
In this section, "department" means the Texas Department of |
|
|
Insurance. |
|
|
(b) The commission shall enter into a memorandum of |
|
|
understanding with the department for purposes of providing to the |
|
|
department the name of and contact information for each individual |
|
|
who is being disenrolled from Medicaid, subject to the individual's |
|
|
consent, so that the department may conduct outreach efforts to |
|
|
assist the individual with applying for and obtaining health |
|
|
benefits coverage. |
|
|
(c) The memorandum of understanding required under |
|
|
Subsection (b) must require that: |
|
|
(1) the commission obtain the written consent of an |
|
|
individual to provide the individual's information to the |
|
|
department; and |
|
|
(2) the information be provided and maintained in a |
|
|
manner consistent with federal and state privacy laws. |
|
|
SECTION 2. If before implementing any provision of this Act |
|
|
a state agency determines that a waiver or authorization from a |
|
|
federal agency is necessary for implementation of that provision, |
|
|
the agency affected by the provision shall request the waiver or |
|
|
authorization and may delay implementing that provision until the |
|
|
waiver or authorization is granted. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
