A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to notice requirements for certain state highway projects. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 203.022, Transportation Code, is amended |
|
|
by adding Subsection (d) to read as follows: |
|
|
(d) The department shall send the notice required by |
|
|
Subsection (a) by certified mail, return receipt requested. The |
|
|
department shall request that an adjoining property owner who is |
|
|
notified of a state highway project under this section submit a |
|
|
response to the department, in a form and manner prescribed by |
|
|
department rule and not later than the 60th day after the date the |
|
|
owner receives the notice, acknowledging receipt of the notice. If |
|
|
the department does not receive an acknowledgement from the |
|
|
adjoining property owner on or before the 60th day after the date |
|
|
the department mailed the notice, the department shall, through the |
|
|
appropriate department district office, identify each known |
|
|
address of the property owner, including the owner's last known |
|
|
residence address if that address is different from the property |
|
|
address, and make a reasonable effort to locate and provide |
|
|
personal notice to the owner. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
