A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the establishment of service credit in the Teacher |
|
|
Retirement System of Texas for certain military service by members |
|
|
of the Texas National Guard. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 823.301(a), Government Code, is amended |
|
|
to read as follows: |
|
|
(a) Military [Except as provided by Section 823.101(2), |
|
|
military] service creditable in the retirement system is: |
|
|
(1) active federal duty in the armed forces of the |
|
|
United States, other than as a student at a service academy, that |
|
|
was performed: |
|
|
(A) [(1)] as a direct result of being inducted or |
|
|
of first enlisting for duty on a date when the federal government |
|
|
was actively inducting persons into the armed forces under federal |
|
|
draft laws; |
|
|
(B) [(2)] as a reservist or member of the |
|
|
national guard who was ordered to duty under the authority of |
|
|
federal law; |
|
|
(C) [(3)] during a time when the federal |
|
|
government was actively inducting persons into the armed forces |
|
|
under federal draft laws; or |
|
|
(D) [(4)] as a result of voluntarily entering on |
|
|
active duty; or |
|
|
(2) state active duty in the Texas National Guard, as |
|
|
those terms are defined by Section 437.001. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
