A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to restrictive covenants prohibiting the display of a sign |
|
|
containing a political message. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 259.002, Election Code, is amended by |
|
|
adding Subsection (b-1) to read as follows: |
|
|
(b-1) Except as otherwise provided by this section, a |
|
|
property owners' association may not enforce or adopt a restrictive |
|
|
covenant that prohibits a property owner from displaying on the |
|
|
owner's property at least one sign that contains primarily a |
|
|
political message other than advertising a candidate or measure for |
|
|
an election. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
