A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to quality standards for the sale of aggregates and |
|
|
concrete. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subtitle B, Title 5, Health and Safety Code, is |
|
|
amended by adding Chapter 375 to read as follows: |
|
|
CHAPTER 375. CONCRETE QUALITY STANDARDS |
|
|
Sec. 375.001. DEFINITIONS. In this chapter: |
|
|
(1) "Aggregates" has the meaning assigned by Section |
|
|
133.003, Natural Resources Code. |
|
|
(2) "Commission" means the Texas Commission on |
|
|
Environmental Quality. |
|
|
Sec. 375.002. QUALITY STANDARDS; PROHIBITION. (a) The |
|
|
commission by rule shall: |
|
|
(1) adopt concrete quality standards; and |
|
|
(2) prohibit the sale of: |
|
|
(A) concrete that does not conform with the |
|
|
standards adopted under Subdivision (1); and |
|
|
(B) aggregates for use in mixing concrete that do |
|
|
not conform with the standards adopted under Subdivision (1). |
|
|
(b) In adopting concrete quality standards, the commission |
|
|
shall consider concrete quality standards published by the National |
|
|
Ready Mixed Concrete Association. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
