A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the approval of subdivision plans and plats by a |
|
|
municipality |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 212.009(a), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(a) The municipal authority responsible for approving plats |
|
|
shall approve, approve with conditions, or disapprove a plat, all |
|
|
applicable submittal documents, including construction drawings, |
|
|
traffic impact analysis, drainage reports, and all other required |
|
|
documents, permits, or approvals to obtain a final plat within 30 |
|
|
days after the date the plat is filed. A plat is approved by the |
|
|
municipal authority unless it is disapproved within that period and |
|
|
in accordance with Section 212.0091. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
