A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to traveling with a child to facilitate the provision of |
|
certain gender transitioning or gender reassignment procedures or |
|
treatments to that child; creating a criminal offense. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter X, Chapter 161, Health and Safety |
|
Code, as added by Chapter 335 (S.B. 14), Acts of the 88th |
|
Legislature, Regular Session, 2023, is amended by adding Section |
|
161.707 to read as follows: |
|
Sec. 161.707. CRIMINAL OFFENSE. (a) A person commits an |
|
offense if the person travels from this state to a location outside |
|
this state with a child who is a resident of this state to |
|
facilitate the child's ability to receive a procedure or treatment |
|
that would otherwise be prohibited by Section 161.702 if the |
|
procedure or treatment occurred in this state. |
|
(b) It is an exception to the application of this section |
|
that the conduct occurred solely to enable the child to receive a |
|
procedure or treatment that is authorized under Section 161.703. |
|
(c) An offense under this section is a felony of the first |
|
degree. |
|
SECTION 2. It is the intent of the 89th Legislature, Regular |
|
Session, 2025, that the amendments made by this Act to Subchapter X, |
|
Chapter 161, Health and Safety Code, be harmonized with another Act |
|
of the 89th Legislature, Regular Session, 2025, relating to |
|
nonsubstantive additions to and corrections in enacted codes. |
|
SECTION 3. This Act takes effect September 1, 2025. |
