A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to amending the Texas General Arbitration Act. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 16.073, Subchapter D, Chapter 16, Civil |
|
|
Practice and Remedies Code, is amended by striking Subsections (a) |
|
|
and (b) and substituting the following: |
|
|
Sec. 16.073. APPLICABILITY OF LIMITATIONS PERIODS TO |
|
|
ARBITRATION. A claim sought to be arbitrated is subject to the same |
|
|
limitations of time for the commencement of actions as if the claims |
|
|
had been asserted in a court. Commencing an action by filing suit |
|
|
in a court of competent jurisdiction will serve to toll limitations |
|
|
of time for binding arbitration of the same action. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect on the 91st day after the last day of the |
|
|
legislative session. |
