A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to compliance reviews and life safety code surveys of |
|
|
assisted living facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 247.0261, Health and |
|
|
Safety Code, is amended to read as follows: |
|
|
Sec. 247.0261. [EARLY] COMPLIANCE REVIEW REQUIRED BEFORE |
|
|
COMPLETION. |
|
|
SECTION 2. Section 247.0261(a), Health and Safety Code, is |
|
|
amended to read as follows: |
|
|
(a) The executive commissioner by rule shall adopt a |
|
|
procedure under which a person who constructs or modifies an |
|
|
assisted living facility or proposes [proposing] to construct or |
|
|
modify an assisted living facility may submit building plans to the |
|
|
department for review for compliance with the department's |
|
|
architectural requirements before completing [beginning] |
|
|
construction or modification. In adopting the procedure, the |
|
|
executive commissioner shall set reasonable deadlines by which the |
|
|
department must complete review of submitted plans. |
|
|
SECTION 3. Subchapter B, Chapter 247, Health and Safety |
|
|
Code, is amended by adding Section 247.02615 to read as follows: |
|
|
Sec. 247.02615. LIFE SAFETY CODE SURVEYS AUTHORIZED BEFORE |
|
|
COMPLETION. A person who constructs or modifies an assisted living |
|
|
facility may request a life safety code survey for the facility |
|
|
before the construction or modification is completed. |
|
|
SECTION 4. As soon as practicable after the effective date |
|
|
of this Act, the executive commissioner of the Health and Human |
|
|
Services Commission shall adopt rules necessary to implement the |
|
|
changes in law made by this Act. |
|
|
SECTION 5. This Act takes effect September 1, 2025. |
