A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the time period for municipal approval, conditional |
|
|
approval, or disapproval of a plat. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 212.009, Local Government Code, is |
|
|
amended by adding Subsection (a-1) to read as follows: |
|
|
(a-1) For the purpose of Subsection (a), a plat application |
|
|
is considered filed on the day the applicant pays the first required |
|
|
fee applicable to the application to the municipal authority |
|
|
responsible for approving the plat. |
|
|
SECTION 2. Section 212.009, Local Government Code, as |
|
|
amended by this Act, applies only to a plat application filed on or |
|
|
after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
