A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notices of appeals for matters within the exclusive |
|
|
intermediate appellate jurisdiction of the Court of Appeals for the |
|
|
Fifteenth Court of Appeals District. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 22.220, Government Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) A party may not file a notice of appeal in a civil case |
|
|
requesting assignment of the appeal to the Court of Appeals for the |
|
|
Fifteenth Court of Appeals District unless the notice includes a |
|
|
matter arising out of or related to the case that is within the |
|
|
court's exclusive intermediate appellate jurisdiction. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a notice of appeal filed on or after the effective date of this |
|
|
Act. A notice of appeal filed before the effective date of this Act |
|
|
is governed by the law in effect on the date the notice was filed, |
|
|
and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
