A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to policies related to the removal and placement of a child |
|
|
by the Department of Family and Protective Services. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 262.114, Family Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) In making a placement decision for a child, the |
|
|
department may not consider the citizenship or immigration status |
|
|
of a relative or other designated caregiver. |
|
|
SECTION 2. Section 262.116, Family Code, is amended by |
|
|
adding Subsection (a-1) to read as follows: |
|
|
(a-1) When deciding whether to take possession of a child |
|
|
under this subchapter, the department may not consider the |
|
|
citizenship or immigration status of the child's parent. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
