A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirement for a motor vehicle emissions test on
  resale of certain vehicles.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 548.3011, Transportation Code, is
  amended by amending Subsection (b) and adding Subsection (b-1) to
  read as follows:
         (b)  Notwithstanding Subsection (a), this section does not
  apply to a vehicle that is a 1996 or newer model that has less than
  the greater of:
               (1)  50,000 miles; or
               (2)  the mileage established by commission rule under
  Subsection (b-1)(2).
         (b-1)  Not later than February 1 of each even-numbered year,
  the commission shall conduct a study on the impact of increasing the
  mileage exemption provided by Subsection (b). Not later than 180
  days after commencing a study under this subsection, the commission
  shall:
               (1)  publish the results of the study on the
  department's Internet website; and
               (2)  adopt a rule increasing the mileage exemption
  provided by Subsection (b) to the next nearest 5,000 miles that the
  commission finds does not adversely impact the state's air quality
  state implementation plan.
         SECTION 2.  This Act takes effect September 1, 2025.
