A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a municipality or county to allow the |
|
|
construction of multifamily housing in certain areas. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 250, Local Government Code, is amended |
|
|
by adding Section 250.014 to read as follows: |
|
|
Sec. 250.014. REGULATIONS RELATED TO CONSTRUCTION OF |
|
|
MULTIFAMILY HOUSING IN CERTAIN RESIDENTIAL AREAS. (a) |
|
|
Notwithstanding any other law, a municipality or county may not |
|
|
adopt or enforce an ordinance, order, zoning variance, or other |
|
|
regulation that allows for the construction of a multifamily |
|
|
housing unit in an area that consists predominantly of single |
|
|
family residences. |
|
|
(b) A person aggrieved by a violation of Subsection (a) may |
|
|
bring an action for economic damages or injunctive relief against a |
|
|
municipality or county. |
|
|
(c) A person who prevails in an action under this section is |
|
|
entitled to recover treble damages. |
|
|
(d) Governmental immunity of a municipality or county to |
|
|
suit and from liability is waived to the extent of liability created |
|
|
by this section. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
