A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to boil water notices issued by public drinking water |
|
supply systems. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 341, Health and Safety |
|
Code, is amended by adding Section 341.043 to read as follows: |
|
Sec. 341.043. BOIL WATER NOTICES. (a) The commission shall |
|
require an operator of a public drinking water supply system to |
|
issue a boil water notice not later than 12 hours after the public |
|
drinking water supply system learns of: |
|
(1) a violation by the system of rules adopted by the |
|
commission under this subchapter that creates a significant |
|
potential for human health to be seriously adversely affected; or |
|
(2) a situation that creates a significant potential |
|
for human health to be adversely affected by water from the system. |
|
(b) If the violation or situation has not been resolved 48 |
|
hours after the boil water notice was issued, the public drinking |
|
water supply system shall reissue the boil water notice with a |
|
statement describing the actions the public drinking water supply |
|
system is taking to address the violation or situation. |
|
(c) A public drinking water supply system may issue a boil |
|
water notice by any means of direct communication that meets the |
|
requirements of the federal Safe Drinking Water Act (42 U.S.C. |
|
Section 300f et seq.). |
|
SECTION 2. This Act takes effect September 1, 2025. |
