A JOINT RESOLUTION
|
|
proposing a constitutional amendment eliminating the statute of |
|
limitations for suits for personal injury arising from certain |
|
sexual offenses against a child. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article I, Texas Constitution, is amended by |
|
adding Section 37 to read as follows: |
|
Sec. 37. (a) Regardless of any statute of limitation, a |
|
person may bring a suit for personal injury at any time if the |
|
injury arose as a result of conduct that violates a penal law |
|
involving a sexual offense against a child. |
|
(b) In this section, "sexual offense" means: |
|
(1) sexual assault of a child; |
|
(2) aggravated sexual assault of a child; |
|
(3) continuous sexual abuse of a young child; |
|
(4) trafficking of a child and causing the child to |
|
engage in or become the victim of conduct that violates a penal law |
|
involving: |
|
(A) continuous sexual abuse of a young child; |
|
(B) indecency with a child; |
|
(C) sexual assault; |
|
(D) aggravated sexual assault; or |
|
(E) compelling prostitution; |
|
(5) sexual conduct with a trafficked child; |
|
(6) compelling prostitution by a child; or |
|
(7) indecency with a child. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 4, 2025. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment eliminating the |
|
statute of limitations for suits for personal injury arising from |
|
certain sexual offenses against a child." |
