A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment allowing an impeached officer |
|
|
to continue in office pending the impeachment trial. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 5, Article XV, Texas Constitution, is |
|
|
amended to read as follows: |
|
|
Sec. 5. All officers against whom articles of impeachment |
|
|
may be preferred are entitled to continue to [shall be suspended |
|
|
from the] exercise [of] the duties of their office, during the |
|
|
pendency of such impeachment. [The Governor may make a provisional |
|
|
appointment to fill the vacancy, occasioned by the suspension of an |
|
|
officer until the decision on the impeachment.] |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 4, 2025. |
|
|
The ballot shall be printed to permit voting for or against the |
|
|
proposition: "The constitutional amendment allowing an impeached |
|
|
officer to continue in office pending the impeachment trial." |
