A JOINT RESOLUTION
  proposing a constitutional amendment requiring automatic
  resignation of a city council member or member of the board of
  trustees of a school district who becomes a candidate for the
  legislature or the United States Congress.
         BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11, Article XI, Texas Constitution, is
  amended by adding Subsection (a-1) to read as follows:
         (a-1)  A city council member serving any length of term of
  office is subject to Section 65(b), Article XVI, of this
  constitution, in the same manner as a county or district officer to
  which that section applies, if the member announces the member's
  candidacy in an election for the Texas Senate, Texas House of
  Representatives, or United States Congress.
         SECTION 2.  Section 65, Article XVI, Texas Constitution, is
  amended to read as follows:
         Sec. 65.  (a)  This section applies to the following
  offices: District Clerks; County Clerks; County Judges; Judges of
  the County Courts at Law, County Criminal Courts, County Probate
  Courts and County Domestic Relations Courts; County Treasurers;
  Criminal District Attorneys; County Surveyors; County
  Commissioners; Justices of the Peace; Sheriffs; Assessors and
  Collectors of Taxes; District Attorneys; County Attorneys; Public
  Weighers; [and] Constables; and Members of the Board of Trustees of
  a School District.
         (b)  Except as provided by Subsection (c) of this section, if
  [If] any of the officers named herein shall announce their
  candidacy, or shall in fact become a candidate, in any General,
  Special or Primary Election, for any office of profit or trust under
  the laws of this State or the United States other than the office
  then held, at any time when the unexpired term of the office then
  held shall exceed one year and 30 days, such announcement or such
  candidacy shall constitute an automatic resignation of the office
  then held, and the vacancy thereby created shall be filled pursuant
  to law in the same manner as other vacancies for such office are
  filled.
         (c)  A member of the board of trustees of a school district is
  only subject to Subsection (b) of this section if the member
  announces the member's candidacy in an election for the Texas
  Senate, Texas House of Representatives, or United States Congress.
         SECTION 3.  This proposed constitutional amendment shall be
  submitted to the voters at an election to be held November 4, 2025.
  The ballot shall be printed to provide for voting for or against the
  proposition: "The constitutional amendment requiring automatic
  resignation of a city council member or member of the board of
  trustees of a school district who becomes a candidate for the
  legislature or the United States Congress."
