A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to memorial markers for certain officers killed in the |
|
line of duty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 225.021(c), Transportation Code, is |
|
amended to read as follows: |
|
(c) Except as provided by Section 225.0215, the [The] |
|
department may not design, construct, or erect a marker under this |
|
subchapter unless a grant or donation of funds is made to the |
|
department to cover the cost of the design, construction, and |
|
erection of the marker. |
|
SECTION 2. Subchapter B, Chapter 225, Transportation Code, |
|
is amended by adding Section 225.0215 to read as follows: |
|
Sec. 225.0215. MEMORIAL MARKERS FOR CERTAIN OFFICERS KILLED |
|
IN LINE OF DUTY. (a) This section applies only to a marker required |
|
under this subchapter designating a part of the highway system, |
|
including a bridge or street, for an individual killed in the line |
|
of duty who was: |
|
(1) a law enforcement officer or peace officer for |
|
this state or a political subdivision of this state under Article |
|
2A.001, Code of Criminal Procedure; or |
|
(2) a federal law enforcement officer or special agent |
|
performing duties in this state, including those officers under |
|
Article 2A.002, Code of Criminal Procedure. |
|
(b) Notwithstanding Section 225.021(c), the department may |
|
design, construct, or erect a marker to which this section applies |
|
using: |
|
(1) money appropriated from the general revenue fund |
|
to the department for those purposes; and |
|
(2) gifts, grants, and donations accepted by the |
|
department for those purposes. |
|
SECTION 3. This Act takes effect September 1, 2025. |
