A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the prohibition of lane restrictions on a portion of |
|
|
Interstate Highway 635. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Subchapter E, Chapter 228, |
|
|
Transportation Code, is amended to read as follows: |
|
|
SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL |
|
|
COLLECTION, LANE RESTRICTIONS, AND[;] CONVERSION OF NONTOLLED |
|
|
STATE HIGHWAY |
|
|
SECTION 2. Subchapter E, Chapter 228, Transportation Code, |
|
|
is amended by adding Section 228.208 to read as follows: |
|
|
Sec. 228.208. LANE RESTRICTIONS ON PORTION OF INTERSTATE |
|
|
HIGHWAY 635 PROHIBITED. Notwithstanding any other provision of |
|
|
this subtitle, the department may not place a lane restriction, |
|
|
including charging a toll or implementing managed lanes, either |
|
|
directly or indirectly through an agreement with another entity, on |
|
|
the portion of Interstate Highway 635 between its intersection with |
|
|
Interstate Highway 30 and its intersection with U.S. Highway 75. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
