A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the regulation of used automotive parts recycling, |
|
including the removal of license plates and registration insignia. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 2309, Occupations Code, is |
|
amended by adding Section 2309.006 to read as follows: |
|
Sec. 2309.006. APPLICABILITY OF CHAPTER TO CASUAL SALE OR |
|
INCIDENTAL ENGAGEMENT IN USED AUTOMOTIVE PARTS RECYCLING. (a) |
|
This chapter does not apply to a person who engages in the casual |
|
sale of used automotive parts or otherwise engages in used |
|
automotive parts recycling as an incidental part of the person's |
|
business. |
|
(b) The commission shall adopt rules to implement |
|
Subsection (a). |
|
SECTION 2. Section 2309.352, Occupations Code, is amended |
|
to read as follows: |
|
Sec. 2309.352. REMOVAL OF LICENSE PLATES AND REGISTRATION |
|
INSIGNIA. Immediately on receipt of a motor vehicle, a used |
|
automotive parts recycler shall: |
|
(1) remove any [unexpired] license plates and |
|
registration insignia from the vehicle; and |
|
(2) place the license plates in a secure place until |
|
destroyed by the used automotive parts recycler. |
|
SECTION 3. This Act takes effect September 1, 2025. |
