A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to use of compost in landscaping, capital construction, |
|
and road maintenance projects by the Texas Department of |
|
Transportation. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|
is amended by adding Section 201.626 to read as follows: |
|
Sec. 201.626. USE OF COMPOST. (a) In this section, |
|
"compost" means the disinfected and stabilized product of the |
|
decomposition process that is used or sold for use as a soil |
|
amendment, artificial top soil, growing medium amendment, or other |
|
similar uses. |
|
(b) The department shall use compost: |
|
(1) for at least 25 percent of the soil required for |
|
landscaping projects; and |
|
(2) when feasible in capital construction and road |
|
maintenance projects. |
|
SECTION 2. The changes in law made by this Act apply only to |
|
a contract for a landscaping, capital construction, or road |
|
maintenance project for which the Texas Department of |
|
Transportation first advertises or otherwise solicits bids, |
|
proposals, offers, or qualifications, or makes a similar |
|
solicitation, on or after the effective date of this Act. A contract |
|
for which the Texas Department of Transportation first advertises |
|
or otherwise solicits bids, proposals, offers, or qualifications, |
|
or makes a similar solicitation, before the effective date of this |
|
Act is governed by the law in effect on the date the advertisement |
|
or solicitation is made, and that law is continued in effect for |
|
that purpose. |

SECTION 3. This Act takes effect September 1, 2025. |
