A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the eligibility of postsecondary educational |
|
institutions to participate in the governor's university research |
|
initiative. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 62.003(1), Education Code, is amended to |
|
read as follows: |
|
(1) Except as otherwise provided by Subchapters C, D, |
|
E, F, G, H, and I, "eligible institution" means the eligible |
|
agencies and institutions of higher education listed in [Article |
|
VII,] Section 17(b), Article VII, Texas [of the] Constitution [of |
|
Texas], and any institution or agency of higher education that is |
|
later made eligible to participate in the disbursement of funds |
|
pursuant to [Article VII,] Section 17(c) of that article[, of the |
|
Constitution of Texas]. |
|
SECTION 2. Section 62.161(2), Education Code, is amended to |
|
read as follows: |
|
(2) "Eligible institution" means: |
|
(A) a general academic teaching institution; |
|
(B) a [or] medical and dental unit; or |
|
(C) a private or independent institution of |
|
higher education. |
|
SECTION 3. Section 62.163(d), Education Code, is amended to |
|
read as follows: |
|
(d) A matching grant may not be used by an eligible |
|
institution to recruit a distinguished researcher from[: |
|
[(1)] another eligible institution[; or |
|
[(2) a private or independent institution of higher |
|
education]. |
|
SECTION 4. Sections 62.161(2) and 62.163(d), Education |
|
Code, as amended by this Act, apply beginning with grants awarded |
|
for the 2025-2026 academic year. |
|
SECTION 5. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2025. |
