A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the requirement that a state agency grant an |
|
|
opportunity for a public hearing before adopting certain rules. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2001.029(b), Government Code, is amended |
|
|
to read as follows: |
|
|
(b) A state agency shall grant an opportunity for a public |
|
|
hearing before it adopts a substantive rule if a public hearing is |
|
|
requested by: |
|
|
(1) at least 10 [25] persons; |
|
|
(2) a governmental subdivision or agency; [or] |
|
|
(3) the lieutenant governor or a member of the |
|
|
legislature; or |
|
|
(4) an association having at least 10 [25] members. |
|
|
SECTION 2. Section 2001.029(b), Government Code, as amended |
|
|
by this Act, applies only to a rule proposed by a state agency on or |
|
|
after the effective date of this Act. A rule proposed before the |
|
|
effective date of this Act is governed by the law in effect |
|
|
immediately before that date, and the former law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
