A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requiring payment and performance bonds for certain |
|
|
public work contracts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.0171, Parks and Wildlife Code, is |
|
|
amended by adding Subsection (a-1) to read as follows: |
|
|
(a-1) For a contract described by Subsection (a)(2) that is |
|
|
also a public work contract, as that term is defined by Section |
|
|
2253.001, Government Code, the director shall require the |
|
|
contractor, before beginning work on the contract, to execute with |
|
|
the department: |
|
|
(1) a performance bond if the contract is greater than |
|
|
$150,000; and |
|
|
(2) a payment bond if the contract is greater than |
|
|
$150,000. |
|
|
SECTION 2. (a) Section 11.0171, Parks and Wildlife Code, as |
|
|
amended by this Act, applies only to a public work contract for |
|
|
which the Parks and Wildlife Department first advertises or |
|
|
otherwise requests bids, proposals, or qualifications, or makes a |
|
|
similar solicitation, on or after the effective date of this Act. |
|
|
(b) A public work contract for which the Parks and Wildlife |
|
|
Department first advertises or otherwise requests bids, proposals, |
|
|
or qualifications, or makes a similar solicitation, before the |
|
|
effective date of this Act is governed by the law as it existed |
|
|
immediately before that date, and that law is continued in effect |
|
|
for that purpose. |

|
SECTION 3. This Act takes effect September 1, 2025. |
