A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the inspection of group homes by county fire marshals. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 352.0165, Local |
|
|
Government Code, is amended to read as follows: |
|
|
Sec. 352.0165. INSPECTION OF GROUP HOMES [IN CERTAIN |
|
|
COUNTIES]; FEE. |
|
|
SECTION 2. Section 352.0165(a)(1), Local Government Code, |
|
|
is amended to read as follows: |
|
|
(1) "Group home" has the meaning assigned by Section |
|
|
769.001, Health and Safety Code, as added by Chapter 141 (S.B. 188), |
|
|
Acts of the 88th Legislature, Regular Session, 2023 [means an |
|
|
establishment: |
|
|
[(A) in which three or more individuals who are |
|
|
unrelated to the owner or operator of the establishment reside; |
|
|
[(B) that provides residential care services to |
|
|
residents; and |
|
|
[(C) that receives payment or other compensation |
|
|
from a local, state, or federal governmental entity for providing |
|
|
residential care services to a resident]. |
|
|
SECTION 3. Section 352.0165(b), Local Government Code, is |
|
|
repealed. |
|
|
SECTION 4. It is the intent of the 89th Legislature, Regular |
|
|
Session, 2025, that the amendments made by this Act be harmonized |
|
|
with another Act of the 89th Legislature, Regular Session, 2025, |
|
|
relating to nonsubstantive additions to and corrections in enacted |
|
|
codes. |
|
|
SECTION 5. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
