A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of an appellate court to issue temporary |
|
|
orders in connection with an interlocutory appeal. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 51.014, Civil Practice and Remedies |
|
|
Code, is amended by adding Subsection (i) to read as follows: |
|
|
(i) Notwithstanding a stay of trial court proceedings under |
|
|
this section, an appellate court may enlist the assistance of a |
|
|
trial court in hearing evidence, making findings of fact, and |
|
|
making recommendations relating to the appellate court's authority |
|
|
to issue temporary orders necessary to preserve a party's rights |
|
|
until disposition of an appeal. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
