A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice provided to certain state and local officials |
|
|
regarding an appeal of a municipal order filed by a transmission and |
|
|
distribution utility in a ratemaking proceeding. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 33, Utilities Code, is |
|
|
amended by adding Section 33.0535 to read as follows: |
|
|
Sec. 33.0535. NOTICE OF APPEAL BY TRANSMISSION AND |
|
|
DISTRIBUTION UTILITY. On receiving a petition under Section 33.053 |
|
|
filed by a transmission and distribution utility, the commission |
|
|
shall provide notice of the appeal to: |
|
|
(1) each member of the legislature whose district |
|
|
includes territory in the municipality that is the subject of the |
|
|
appeal; and |
|
|
(2) the governing bodies of the municipality that is |
|
|
the subject of the appeal and the county in which that municipality |
|
|
is located. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an appeal of a rate proceeding that is filed on or after the |
|
|
effective date of this Act. An appeal of a rate proceeding that is |
|
|
filed before the effective date of this Act is governed by the law |
|
|
in effect immediately before the effective date of this Act, and |
|
|
that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
