A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to health benefit plan coverage of anxiety and pain |
|
management in connection with prescription contraceptive devices. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1369.1031, Insurance Code, is amended by |
|
adding Subsections (e) and (f) to read as follows: |
|
(e) A health benefit plan that provides benefits for forms |
|
of contraception approved by the United States Food and Drug |
|
Administration must provide coverage of evidence-based anxiety and |
|
pain management related to the insertion and removal of |
|
contraception, including: |
|
(1) prescription antianxiety medication; |
|
(2) minimal and moderate sedation; |
|
(3) local anesthesia; |
|
(4) topical anesthetics; and |
|
(5) paracervical blocks. |
|
(f) The coverage described by Subsection (e) is not subject |
|
to a cost-sharing requirement, including a deductible or |
|
coinsurance, utilization review, or step therapy, or any other |
|
restriction or delay on coverage. |
|
SECTION 2. The change in law made by this Act applies only |
|
to a health benefit plan that is delivered, issued for delivery, or |
|
renewed on or after January 1, 2026. |
|
SECTION 3. This Act takes effect September 1, 2025. |
