A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the facility or location at which public school |
|
|
prekindergarten classes may be provided in partnership with a |
|
|
private entity. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 29.153, Education Code, is amended by |
|
|
adding Subsection (h) to read as follows: |
|
|
(h) Notwithstanding any other law, a facility or location at |
|
|
which prekindergarten classes are provided by a school district or |
|
|
open-enrollment charter school in partnership with a private entity |
|
|
under this section may not be required to comply with: |
|
|
(1) any municipal ordinance applicable to the |
|
|
operation of a private prekindergarten program other than a |
|
|
municipal ordinance providing a local occupancy restriction; or |
|
|
(2) any municipal ordinance applicable to the |
|
|
operation of a prekindergarten program by a school district or |
|
|
open-enrollment charter school. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
