A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Texas Department of Transportation |
|
|
to settle certain claims. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 201.106(b), Transportation Code, is |
|
|
amended to read as follows: |
|
|
(b) The department may settle a claim described by |
|
|
Subsection (a) if: |
|
|
(1) the department may be liable under Chapter 101, |
|
|
Civil Practice and Remedies Code; |
|
|
(2) the director determines that a settlement is in |
|
|
the best interest of the department; and |
|
|
(3) the department's liability under the terms of the |
|
|
settlement is less than $100,000 [$10,000]. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
