A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the right of property owners to challenge municipal |
|
|
zoning regulations and boundaries. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 211, Local Government Code |
|
|
is amended by adding Sections 211.020 to read as follows: |
|
|
Sec. 211.020. ENFORCEMENT OF CHAPTER. (a) This chapter may |
|
|
be enforced only through mandamus or declaratory or injunctive |
|
|
relief. |
|
|
(b) A political subdivision's immunity from suit is waived |
|
|
in regard to an action under this chapter. |
|
|
(c) A court may award court costs and reasonable and |
|
|
necessary attorney's fees to the prevailing party in an action |
|
|
under this chapter. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
