A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the monitoring of the opacity of emissions from certain |
|
concrete facilities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 382, Health and Safety |
|
Code, is amended by adding Section 382.0162 to read as follows: |
|
Sec. 382.0162. MONITORING OF OPACITY OF EMISSIONS FROM |
|
CERTAIN CONCRETE FACILITIES. (a) This section applies only to a |
|
person who holds a permit issued under this chapter or is authorized |
|
to use a permit issued under this chapter relating to the operation |
|
of a facility: |
|
(1) used for concrete crushing; or |
|
(2) that is a concrete plant that performs wet |
|
batching, dry batching, or central mixing. |
|
(b) The commission by rule shall require a person described |
|
by Subsection (a) to staff the site of the permitted facility during |
|
all operational hours with an employee or agent who has received |
|
training on opacity readings, methodology, and procedures to |
|
monitor the opacity of emissions of air contaminants from the |
|
facility in compliance with commission rules. |
|
SECTION 2. This Act takes effect September 1, 2025. |
