A BILL TO BE ENTITLED
 
AN ACT
  relating to the monitoring of the opacity of emissions from certain
  concrete facilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 382, Health and Safety
  Code, is amended by adding Section 382.0162 to read as follows:
         Sec. 382.0162.  MONITORING OF OPACITY OF EMISSIONS FROM
  CERTAIN CONCRETE FACILITIES. (a)  This section applies only to a
  person who holds a permit issued under this chapter or is authorized
  to use a permit issued under this chapter relating to the operation
  of a facility:
               (1)  used for concrete crushing; or
               (2)  that is a concrete plant that performs wet
  batching, dry batching, or central mixing.
         (b)  The commission by rule shall require a person described
  by Subsection (a) to staff the site of the permitted facility during
  all operational hours with an employee or agent who has received
  training on opacity readings, methodology, and procedures to
  monitor the opacity of emissions of air contaminants from the
  facility in compliance with commission rules.
         SECTION 2.  This Act takes effect September 1, 2025.
