A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to notice of certain misconduct committed by a public |
|
school educator. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 21, Education Code, is |
|
amended by adding Section 21.0063 to read as follows: |
|
Sec. 21.0063. NOTICE OF CERTAIN EDUCATOR MISCONDUCT. |
|
(a) If, after investigation by a school district or open-enrollment |
|
charter school, there is reason to believe that a district or school |
|
educator engaged in misconduct described by Section |
|
21.006(b)(2)(A-1) with a student enrolled at the district or |
|
school, the district or school shall provide written notice of the |
|
misconduct to each parent or guardian of a student enrolled in the |
|
district or school. |
|
(b) The notice required by Subsection (a): |
|
(1) subject to Subdivision (2), must be provided by |
|
mail; and |
|
(2) may be provided by e-mail if the board of trustees |
|
of the school district or the governing body of the open-enrollment |
|
charter school determines that providing the notice by mail would |
|
be too expensive. |
|
SECTION 2. This Act applies beginning with the 2025-2026 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2025. |
