A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a municipality to authorize the |
|
|
creation or expansion of a political subdivision in the corporate |
|
|
boundaries or extraterritorial jurisdiction of the municipality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 41, Local Government Code, is amended by |
|
|
adding Section 41.005 to read as follows: |
|
|
Sec. 41.005. CREATION OR EXPANSION OF POLITICAL SUBDIVISION |
|
|
IN CORPORATE BOUNDARIES. Notwithstanding any other law, no part of |
|
|
a political subdivision may be created or expanded in the corporate |
|
|
boundaries of a municipality unless the governing body of the |
|
|
municipality by ordinance authorizes the creation or expansion. |
|
|
SECTION 2. Subchapter C, Chapter 42, Local Government Code, |
|
|
is amended by adding Section 42.0423 to read as follows: |
|
|
Sec. 42.0423. CREATION OR EXPANSION OF EMERGENCY SERVICES |
|
|
DISTRICT IN EXTRATERRITORIAL JURISDICTION. Notwithstanding any |
|
|
other law, no part of an emergency services district governed by |
|
|
Chapter 775, Health and Safety Code, may be created or expanded in |
|
|
the extraterritorial jurisdiction of a municipality unless the |
|
|
governing body of the municipality by ordinance authorizes the |
|
|
creation or expansion. |

|
SECTION 3. This Act takes effect September 1, 2025. |
