A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to municipal charters that set a minimum or maximum number |
|
|
of municipal employees. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 9, Local Government Code, is amended by |
|
|
adding Section 9.009 to read as follows: |
|
|
Sec. 9.009. PROHIBITION ON CHARTER PROVISIONS RELATED TO |
|
|
NUMBER OF MUNICIPAL EMPLOYEES. (a) A charter may not require the |
|
|
municipality or a department of the municipality to employ a |
|
|
minimum or maximum number of employees, including peace officers |
|
|
and firefighters. |
|
|
(b) Any provision of a charter that violates Subsection (a) |
|
|
is void. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2025. |
