A BILL TO BE ENTITLED
 
AN ACT
  relating to the installation of a treatment system by certain
  public drinking water supply systems.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 341, Health and Safety
  Code, is amended by adding Section 341.0365 to read as follows:
         Sec. 341.0365.  TREATMENT SYSTEMS FOR CERTAIN UNDERGROUND
  SOURCES. The commission by order may require a public drinking
  water supply system that serves fewer than 100 connections and
  obtains its water supply from an underground source to install a
  treatment system, which may include a filtration system, for that
  source if the public water system:
               (1)  has repeatedly exceeded the maximum contaminant
  level or secondary constituent level for one or more parameters
  established by the commission;
               (2)  has been the subject of more than one
  substantiated water quality complaint submitted to the commission,
  not including a complaint submitted to the commission regarding
  water quality issues associated with the distribution system that
  are not related to water quality issues from the underground
  source, during the preceding 12 months for which the commission has
  determined a need to install additional treatment measures,
  including requiring the public water system to install a filtration
  system; and
               (3)  can install at a reasonable cost the treatment
  system for that source to manage an exceedance of a secondary
  constituent level, if applicable.
         SECTION 2.  This Act takes effect September 1, 2025.
