A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the provision of information regarding certain public |
|
assistance programs by public schools. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|
amended by adding Section 38.045 to read as follows: |
|
Sec. 38.045. INFORMATION REGARDING CERTAIN PUBLIC |
|
ASSISTANCE PROGRAMS. (a) Each year and on a student's enrollment |
|
in a school district or open-enrollment charter school, the |
|
district or school shall provide to the student and the student's |
|
parent in any format the district or school determines appropriate |
|
information regarding the eligibility requirements for public |
|
assistance programs, including: |
|
(1) the medical assistance program under Chapter 32, |
|
Human Resources Code; |
|
(2) the child health plan program under Chapter 62, |
|
Health and Safety Code; and |
|
(3) the supplemental nutrition assistance program |
|
under Chapter 33, Human Resources Code. |
|
(b) The Health and Human Services Commission, in |
|
coordination with the agency, shall prepare and make available to |
|
school districts and open-enrollment charter schools in both |
|
physical and electronic formats a model form for the information |
|
required to be provided under Subsection (a). |
|
SECTION 2. This Act applies beginning with the 2025-2026 |
|
school year. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2025. |
