A BILL TO BE ENTITLED
 
AN ACT
  relating to disparate premiums for personal automobile insurance
  policies based on certain characteristics of the insured.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 1953, Insurance Code, is
  amended by adding Section 1953.053 to read as follows:
         Sec. 1953.053.  DISPARATE PREMIUMS BASED ON SEX OR MARITAL
  STATUS PROHIBITED. (a)  This section applies to an insurer writing
  automobile insurance in this state, including an insurance company,
  corporation, reciprocal or interinsurance exchange, mutual
  insurance company, capital stock company, association, county
  mutual insurance company, Lloyd's plan, and any other insurer.
         (b)  An insurer may not impose on a personal automobile
  insurance policy a premium:
               (1)  on an insured who is at least 21 years of age; and
               (2)  that is greater than an insured of the same age
  solely because of:
                     (A)  the sex of the insured; or
                     (B)  the marital status of the insured.
         SECTION 2.  Section 1953.053, Insurance Code, as added by
  this Act, applies only to an insurance policy delivered, issued for
  delivery, or renewed on or after January 1, 2026.
         SECTION 3.  This Act takes effect September 1, 2025.
