A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to disparate premiums for personal automobile insurance |
|
|
policies based on certain characteristics of the insured. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 1953, Insurance Code, is |
|
|
amended by adding Section 1953.053 to read as follows: |
|
|
Sec. 1953.053. DISPARATE PREMIUMS BASED ON SEX OR MARITAL |
|
|
STATUS PROHIBITED. (a) This section applies to an insurer writing |
|
|
automobile insurance in this state, including an insurance company, |
|
|
corporation, reciprocal or interinsurance exchange, mutual |
|
|
insurance company, capital stock company, association, county |
|
|
mutual insurance company, Lloyd's plan, and any other insurer. |
|
|
(b) An insurer may not impose on a personal automobile |
|
|
insurance policy a premium: |
|
|
(1) on an insured who is at least 21 years of age; and |
|
|
(2) that is greater than an insured of the same age |
|
|
solely because of: |
|
|
(A) the sex of the insured; or |
|
|
(B) the marital status of the insured. |
|
|
SECTION 2. Section 1953.053, Insurance Code, as added by |
|
|
this Act, applies only to an insurance policy delivered, issued for |
|
|
delivery, or renewed on or after January 1, 2026. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
