A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the preliminary examination of a person transported to |
|
|
a general hospital's emergency department |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 573.021, Health and Safety Code, is |
|
|
amended by adding Subsection (f) to read as follows: |
|
|
(f) Subsection (b) of this section does not apply to a |
|
|
person transported under 573.001 to a hospital emergency department |
|
|
unless the person remains in custody of a peace officer at the |
|
|
facility or the facility is otherwise licensed to provide mental |
|
|
health services. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
