A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain health care facilities to |
|
|
cooperate with officers engaged in immigration-related duties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subtitle F, Title 4, Health and Safety Code, is |
|
|
amended by adding Chapter 318 to read as follows: |
|
|
CHAPTER 318. COOPERATION WITH OFFICERS ENGAGED IN |
|
|
IMMIGRATION-RELATED DUTIES |
|
|
Sec. 318.001. DEFINITION. In this chapter, "health |
|
|
facility" means: |
|
|
(1) a hospital licensed under Chapter 241; |
|
|
(2) a health care facility owned or operated by a |
|
|
hospital district; and |
|
|
(3) a federally qualified health center as defined by |
|
|
42 U.S.C. Section 1396d(l)(2)(B). |
|
|
Sec. 318.002. COOPERATION WITH OFFICER ENGAGED IN |
|
|
IMMIGRATION-RELATED DUTIES PROHIBITED. A health facility may not |
|
|
grant a federal immigration officer or peace officer engaged in |
|
|
immigration-related investigation or enforcement duties access to |
|
|
the premises of the facility without a judicial warrant. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
