A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the renewal of certain leases in manufactured home |
|
|
communities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 94, Property Code, is |
|
|
amended by adding Section 94.2041 to read as follows: |
|
|
Sec. 94.2041. NONRENEWAL OF LEASE FOR CERTAIN TENANTS WITH |
|
|
MINOR CHILDREN. (a) This section applies only to a lease |
|
|
agreement: |
|
|
(1) with a tenant: |
|
|
(A) who resides in the manufactured home with a |
|
|
minor child; or |
|
|
(B) whose tenant residing in the manufactured |
|
|
home resides in the manufactured home with a minor child; and |
|
|
(2) the expiration of which would occur during a |
|
|
semester of school as determined by the local school district. |
|
|
(b) A landlord that chooses not to renew a lease agreement |
|
|
described by Subsection (a) shall: |
|
|
(1) convert the lease to a month-to-month lease; and |
|
|
(2) renew the month-to-month lease every month until |
|
|
the end of the lease would occur outside of a period described by |
|
|
Subsection (a)(2). |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
a lease agreement entered into or renewed on or after the effective |
|
|
date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2025. |
