A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the prohibited exclusion of certain individuals |
|
|
requiring specialized care from inpatient mental health |
|
|
facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 571, Health and Safety Code, is amended |
|
|
by adding Section 571.0091 to read as follows: |
|
|
Sec. 571.0091. PROHIBITED EXCLUSION OF CERTAIN INDIVIDUALS |
|
|
REQUIRING SPECIALIZED CARE. An inpatient mental health facility |
|
|
may not deny admission to and may not discharge from the facility a |
|
|
patient with a bleeding disorder based solely on the individual's |
|
|
need for specialized treatments, including a bolus injection or |
|
|
subcutaneous injection, if the specialized treatment is a |
|
|
prescribed treatment for a bleeding disorder and administered by: |
|
|
(1) the individual; or |
|
|
(2) a licensed health care provider who is not a |
|
|
facility employee. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
