A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the imposition of a fee for oil and gas waste that is not |
|
|
produced in this state. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 27, Water Code, is amended |
|
|
by adding Section 27.0322 to read as follows: |
|
|
Sec. 27.0322. DISPOSAL FEE. (a) For oil and gas waste that |
|
|
is not produced in this state, the commission shall impose a fee of |
|
|
20 cents per barrel of oil and gas waste. |
|
|
(b) Notwithstanding any other law, contract, or agreement, |
|
|
the cost of a fee imposed under this section may be passed on to the |
|
|
producer of the oil and gas waste if the person required to pay the |
|
|
fee is not the producer. |
|
|
(c) The fee collected under this section shall be deposited |
|
|
to the credit of the oil and gas regulation and cleanup fund as |
|
|
provided by Section 81.067, Natural Resources Code. |
|
|
(d) The commission may adopt rules necessary to implement |
|
|
this section. |
|
|
SECTION 2. This Act takes effect September 1, 2025. |
