A BILL TO BE ENTITLED
 
AN ACT
  relating to strategies to address homelessness and affordable
  housing in certain counties, including the repurposing of land
  located in those counties, the use of certain tax revenue
  attributable to that land, and building restrictions in certain
  municipalities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 3151.002, Government Code, is amended to
  read as follows:
         Sec. 3151.002.  DEFINITION OF CAPITOL VIEW CORRIDOR. In
  this chapter, "Capitol view corridor" means:
               (1)  the South Mall of The University of Texas
  Corridor, which encompasses all of the area between two lines:
                     (A)  one of which begins at an elevation of 594
  feet above sea level at Texas Plane Coordinate X-2818794.86,
  Y-234376.98, and extends along a bearing of S 2 7 0.0 W for a
  distance of 3790.248 feet to a point 100 feet from the center of the
  Capitol dome, this point being located at Texas Plane Coordinate

  of the area between two lines:

                     (B)  the second of which begins at an elevation of

  Y-233307.74, and extends along a bearing of N 41 18 34.5 E for a
  distance of 3525.556 feet to a point 100 feet from the center of the
  Capitol dome, this point being located at Texas Plane Coordinate
  X-2818478.12, Y-230659.50.
               (25) [(30)]  the entrance terrace to the University of
  Texas Swim Center Corridor, which encompasses all of the area
  between two lines:
                     (A)  one of which begins at an elevation of 540
  feet above sea level at Texas Plane Coordinate X-2821029.40,
  Y-232523.71, and extends along a bearing of N 50 14 50.5 E for a
  distance of 3138.424 feet to a point 100 feet from the center of the
  Capitol dome, this point being located at Texas Plane Coordinate
  X-2818616.54, Y-230516.77; and
                     (B)  the second of which begins at an elevation of
  540 feet above sea level at Texas Plane Coordinate X-2820873.01,
  Y-232433.33, and extends along a bearing of N 53 31 42.3 E for a
  distance of 2959.714 feet to a point 100 feet from the center of the
  Capitol dome, this point being located at Texas Plane Coordinate
  X-2818492.95, Y-230674.01.
         SECTION 2.  Section 3151.053, Government Code, is amended to
  read as follows:
         Sec. 3151.053.  CONFLICT WITH OTHER REQUIREMENTS.  (a)
  Except as provided by Subsection (b), if [If] a requirement of this
  chapter conflicts with a requirement enacted by a municipality or
  with any other requirement under state law, the stricter
  requirement prevails.
         (b)  A municipality may not enact a building restriction
  related to the view of the Capitol other than the Capitol view
  corridors provided under Section 3151.002.
         SECTION 3.  Title 7, Government Code, is amended by adding
  Chapter 795 to read as follows:
  CHAPTER 795. AFFORDABLE HOUSING BOARD
         Sec. 795.001.  DEFINITIONS. In this chapter:
               (1)  "Capitol view corridor" has the meaning assigned
  by Section 3151.002.
               (2)  "Eligible county" means a county in which a
  Capitol view corridor is located.
               (3)  "Eligible taxing unit" means a taxing unit that
  imposes an ad valorem tax on real property located in a former
  Capitol view corridor.
               (4)  "First responder" has the meaning assigned by
  Section 78A.001, Civil Practice and Remedies Code.
               (5)  "Former Capitol view corridor" means a Capitol
  view corridor described by Sections 3151.002(10), (12), (14), (15),
  and (17), as those subdivisions existed on January 1, 2025.
               (6)  "Tax increment base" is the total taxable value of
  all real property taxable by a taxing unit and located in a former
  Capitol view corridor on January 1, 2025.
               (7)  "Taxing unit" has the meaning assigned by Section
  1.04, Tax Code.
         Sec. 795.002.  AFFORDABLE HOUSING BOARD; DUTIES.  (a)  The
  affordable housing board is created to address the issues of
  homelessness and affordable housing in eligible counties. The
  board consists of the following members:
               (1)  three members appointed by the governor who have
  experience on issues relating to homelessness and affordable
  housing; and
               (2)  one member appointed by the governing body of each
  eligible taxing unit that elects to deposit the taxing unit's
  incremental tax revenue to the credit of the affordable housing
  fund as authorized under Section 795.004.
         (b)  The affordable housing board shall establish and
  administer a grant program to provide financial assistance to
  public and private entities for purposes of reducing homelessness
  and increasing affordable housing in eligible counties.
         Sec. 795.003.  AFFORDABLE HOUSING FUND. (a) The affordable
  housing board shall establish an affordable housing fund. The
  affordable housing fund consists of:
               (1)  the incremental tax revenue deposited to the
  credit of the fund by eligible taxing units under Section 795.004;
  and
               (2)  any gifts, grants, or donations from a public or
  private entity made to the board for a purpose for which the fund
  may be used.
         (b)  The affordable housing fund must be established as an
  interest bearing account in a financial institution in this state
  in the name of the affordable housing board.
         (c)  Money in the affordable housing fund may be used only
  for a purpose described by Section 795.005.
         Sec. 795.004.  INCREMENTAL TAX REVENUE. (a)  The governing
  body of an eligible taxing unit may by ordinance, resolution, or
  order elect to deposit the taxing unit's incremental tax revenue to
  the credit of the affordable housing fund.
         (b)  The amount of an eligible taxing unit's incremental tax
  revenue for a year is an amount of tax revenue equal to the total
  taxable value of all real property taxable by the taxing unit and
  located in a former Capitol view corridor for that tax year less the
  taxing unit's tax increment base.
         (c)  An eligible taxing unit that elects to deposit the
  taxing unit's incremental tax revenue into the affordable housing
  fund shall each year:
               (1)  provide for the collection of taxes in the former
  Capitol view corridor as for any other real property taxable by the
  taxing unit; and
               (2)  pay into the affordable housing fund the taxing
  unit's incremental tax revenue for that year.
         Sec. 795.005.  GRANTS. (a)  The affordable housing board may
  use money in the affordable housing fund only to award grants to
  private or public entities for projects that address homelessness
  or affordable housing in eligible counties.
         (b)  Grants may be awarded to:
               (1)  provide mortgage or down payment assistance to
  first responders and teachers employed in eligible counties;
               (2)  purchase or construct single- or multi-family
  housing units for use by homeless individuals, first responders, or
  teachers; and
               (3)  reduce homelessness in eligible counties,
  including repurposing and relocating the facilities that house
  homeless individuals in the downtown and business districts of
  municipalities located in eligible counties.
         (c)  The affordable housing board shall adopt procedures for
  applying for a grant and evaluating applications for a grant under
  this chapter.
         Sec. 795.006.  OVERSIGHT. The comptroller shall oversee the
  operation of the affordable housing board and the affordable
  housing fund.
         SECTION 4.  Subchapter D, Chapter 49, Education Code, is
  amended by adding Section 49.1574 to read as follows:
         Sec. 49.1574.  CREDIT FOR INCREMENTAL TAXES PAID INTO
  AFFORDABLE HOUSING FUND. (a) This section applies only to a school
  district that elects to deposit the district's incremental tax
  revenue into an affordable housing fund under Section 795.004,
  Government Code.
         (b)  The total amount required under Section 49.153 for a
  school district to purchase attendance credit under this subchapter
  for any school year is reduced by an amount equal to the incremental
  tax revenue deposited by the district in an affordable housing fund
  under Section 795.004, Government Code, in that school year.
         (c)  A reduction under Subsection (b) shall be made after
  making any reduction to which the district is entitled under
  Section 49.157 or another provision of this chapter.
         SECTION 5.  This Act applies only to ad valorem taxes imposed
  for a tax year that begins on or after the effective date of this
  Act.
         SECTION 6.  This Act takes effect September 1, 2025.
